Noise at Work Regulations for Construction: What UK Contractors Need to Know

Construction is one of the loudest industries in Britain. Prolonged exposure to high noise levels causes noise-induced hearing loss (NIHL) — a permanent, irreversible condition. Understanding the noise at work regulations for construction is essential for every contractor, site manager, and self-employed tradesperson on site.

The Legal Framework

The Control of Noise at Work Regulations 2005 (SI 2005/1643) implement the EU Physical Agents (Noise) Directive in Great Britain and apply fully to construction work. They place duties on employers (and the self-employed) to eliminate or reduce noise risks so far as is reasonably practicable.

These Regulations sit alongside the general risk assessment duty under Regulation 3 of the Management of Health and Safety at Work Regulations 1999, which requires suitable and sufficient assessment of all workplace risks — including noise.

On notifiable construction projects, the Construction (Design and Management) Regulations 2015 also require designers and principal designers to consider noise during the design phase, potentially eliminating noisy processes before work even starts.

The Three Exposure Action and Limit Values

The Regulations set noise levels based on two measures:

In practice, most busy construction activities — disc cutting, breaker work, scabbling, cartridge tools — push workers well above 85 dB(A) within minutes.

Noise Risk Assessment in Construction

A noise risk assessment is not optional once there is a likelihood of exposure at or above the LEAVs. The assessment must:

  1. Identify which workers are at risk and from which tasks or plant
  2. Estimate likely exposure (using measurement data, published HSE noise profiles, or recognised tools such as the HSE's Noise Exposure Calculator)
  3. Identify whether action values or the ELV are likely to be exceeded
  4. Determine and record the controls required
  5. Be reviewed whenever working methods, plant, or crew change significantly

The assessment must be carried out by a competent person. On larger projects that may mean an occupational hygienist; on smaller sites a suitably trained supervisor using HSE published data can often meet the standard.

Controlling Noise: The Correct Hierarchy

The Regulations are explicit — PPE is the last resort, not the first response. Work through the hierarchy:

1. Eliminate

Can the noisy task be removed entirely? Redesigning details to avoid chasing, drilling, or breaking at all is the most effective control.

2. Substitute

Replace noisy plant with quieter alternatives — a diamond-tipped core drill instead of a percussive drill, or pressing/crimping instead of hammering.

3. Engineering controls

  • Use plant with integral noise enclosures or acoustic covers
  • Fit silenced exhausts and anti-vibration mounts on compressors
  • Erect acoustic screens or barriers around particularly noisy operations
  • Maintain plant properly — worn blades and loose covers significantly increase noise output

4. Administrative controls

  • Rotate workers to limit individual daily exposure (but never use rotation as a substitute for engineering controls)
  • Schedule noisy work to quieter periods where the wider workforce is not nearby
  • Restrict access to high-noise areas

5. PPE — hearing protection

Only once the above controls have been applied as far as reasonably practicable should you rely on hearing protection. Where the UEAV is reached or exceeded, hearing protection is mandatory, not advisory. Zones must be clearly marked.

Select protectors with adequate but not excessive attenuation — over-protection isolates workers from warning signals. Use the HSE's single-number rating (SNR) or HML method to match protectors to the noise spectrum.

Health Surveillance

Where workers are regularly exposed at or above the upper exposure action value (85 dB(A) LEP,d), employers must provide health surveillance — as a minimum, periodic audiometric testing. The aim is early detection of NIHL before significant damage accumulates. Records must be kept and workers informed of their results.

Information and Training

Regardless of the level reached, once the LEAV is likely to be exceeded, workers must receive:

  • Information on the nature and extent of the noise risk
  • The controls in place and how to use them
  • How to obtain and correctly use hearing protection
  • Their right to health surveillance

This is not a one-off induction tick-box. Refresher training matters, especially when new plant or processes are introduced.
