Legal Requirement for Risk Assessments

Under Regulation 3 of the Management of Health and Safety at Work Regulations 1999, every employer must carry out a suitable and sufficient assessment of the risks to their employees and anyone else affected by their work. If you have 5 or more employees, you must record the significant findings.

The Construction (Design and Management) Regulations 2015 (CDM 2015) place additional requirements on construction projects, including the preparation of a construction phase plan which must include risk assessments for all significant hazards.

Likelihood (L)

  • 5 — Very likely

Severity (S)

  • 1 — Insignificant
  • 2 — Minor (first aid)
  • 3 — Moderate (medical treatment)
  • 4 — Major (RIDDOR)
  • 5 — Catastrophic (death)

Risk Score = Likelihood x Severity. Scores of 1-4 are low risk, 5-9 medium, 10-15 high, and 16-25 are unacceptable and require immediate additional controls.

Hierarchy of Controls

  • Eliminate — remove the hazard entirely
  • Substitute — replace with something less hazardous
  • Engineering controls — isolate people from the hazard
  • Administrative controls — change the way people work
  • PPE — protect the individual (always last resort)
